Understanding CASL for Canadian Real Estate

Express vs. Implied Consent

Express Consent is obtained when contacts explicitly opt-in (via checkbox or form) to receive newsletters. It never expires unless they unsubscribe.

Implied Consent is granted temporarily during business interactions. This is limited to 24 months for completed transactions (buy/sell/lease contracts) or 6 months for a simple listing inquiry.

Common Mistakes & Pitfalls

Purchased Lists: Buying a list of local homeowner emails is a severe CASL violation. Consent cannot be transferred this way in Canada.

Cold Emailing: Scraping public directory sites is permitted only if the message matches their professional work and no disclaimer is present. Broad cold prospecting to personal emails is illegal.
