Please review these terms carefully. By using Omni Broker AI, you agree to comply with our professional standards and regional regulations.
1. Acceptance of Terms
By accessing or using the Omni Broker AI platform (the "Service"), provided by Omni Broker AI Inc., you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not access or use the Service.
2. Eligibility
The Service is intended for use by real estate professionals licensed and registered with their respective provincial regulatory bodies (e.g., RECO in Ontario). By using the Service, you represent and warrant that you are a licensed real estate professional in good standing.
3. Use of Service
A. Subscriptions
Omni Broker AI provides both free and paid subscription levels. Paid subscriptions are billed in advance on a monthly or annual basis and are non-refundable except where required by law.
B. Prohibited Conduct
You agree not to use the Service to:
- Misrepresent property values or lead intent.
- Engage in illegal cold-calling or SMS spam in violation of CASL.
- Incorporate false or misleading advertising in generated flyers.
- Scrape data from the platform for unauthorized use.
4. Data Ownership & Privacy
Data generated through your marketing campaigns (e.g., lead information) is your property, but we retain a limited license to use anonymized, aggregated data to improve our analytics (such as the B-20 Mobility Score). All personal information is handled in accordance with our Privacy Policy and PIPEDA.
5. MLS® Data Usage
The Service accesses MLS® listing data through authorized data feeds via the Repliers API, sourced from the Toronto Regional Real Estate Board (TRREB). By using the Service, you acknowledge and agree to the following:
- MLS® data is provided for your professional use only and may not be redistributed, resold, or exported to unauthorized platforms.
- The information provided is deemed reliable but is not guaranteed and should be independently verified.
- Sold data display is limited to a maximum of two (2) years, in compliance with TRREB policy.
- All marketing assets generated using MLS® data must retain proper brokerage attribution and data source identification.
- You are responsible for ensuring your use of MLS® data complies with your brokerage's agreements with TRREB.
The trademarks MLS®, Multiple Listing Service® and the associated logos are owned by The Canadian Real Estate Association (CREA). The trademarks REALTOR®, REALTORS® and the REALTOR® logo are controlled by CREA.
6. Intellectual Property
The Omni Broker AI platform, including its software, AI models, and branding, is the exclusive property of Omni Broker AI Inc. You are granted a limited, non-exclusive license to use the platform for your professional marketing purposes.
7. Limitation of Liability
To the maximum extent permitted by Ontario law, Omni Broker AI Inc. shall not be liable for any indirect, incidental, or consequential damages arising from your use of the Service, including but not limited to loss of commissions, data, or business reputation.
8. Governing Law
These Terms of Service shall be governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein.
